Acceptance of Terms

By accessing and using FallCall ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement.

Description of Service

FallCall is a mobile safety application that monitors for potential falls during active ride sessions and sends alert notifications with location data to designated emergency contacts via SMS.

Not a Substitute for Emergency Services

FallCall is NOT a substitute for emergency services. In the event of a medical emergency, call 911 (or your local emergency number) immediately.

FallCall provides fall detection as a best-effort service. We do not guarantee that alerts will be sent, that they will be delivered promptly, or that emergency contacts will respond.

User Responsibilities

• Account Registration: You must provide accurate and complete registration information
• Emergency Contact Consent: By adding an emergency contact, you confirm you have that person's permission to notify them in the event of a detected fall
• Account Security: You are responsible for maintaining the confidentiality of your account credentials
• Device Care: You are responsible for ensuring your device is properly charged and has connectivity for the Service to function

Messaging and Communications

FallCall sends transactional safety alerts via SMS. Standard message and data rates may apply depending on your mobile carrier and plan.

Opt-Out: Emergency contacts may opt out of receiving alerts at any time by replying STOP to any received message. For assistance, reply HELP or contact support@fallcall.app.

Intellectual Property

The FallCall Service, including all content, features, and functionality, is owned by FallCall and is protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FALLCALL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. FALL DETECTION IS A BEST-EFFORT FEATURE AND MAY NOT DETECT ALL FALLS OR MAY PRODUCE FALSE POSITIVES.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FALLCALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL FALLCALL'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE, IF ANY.

Indemnification

You agree to indemnify, defend, and hold harmless FallCall and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

Termination

We may terminate or suspend your account at any time, without prior notice or liability, for any reason, including breach of these Terms.
